DOI Notice on Pending and Registered Trademarks

On August 19, 2025, the Department of Industry ("DOI"), published a notice (“Notice”) in Kantipur Daily with regard to the pending and registered trademarks in Nepal, pursuant to the decision of DOI dated August 15, 2025.

The Notice requires the following actions from applicants who have filed applications for the registration of trademarks under the Patent, Design, and Trademark Act, 2022 (1965 A.D.) ("PDTA") and other applicable laws:

  • Incomplete Applications: Applicants whose applications for trademark registration have not yet been published in the Industrial Property Bulletin due to incomplete submission of required documents are requested to submit the missing documents to the DOI within 90 (ninety) days from the date of publication of the Notice i.e. November 16, 2025.
     
  • Uncollected Certificates: Applicants whose applications have completed all registration formalities including publication in IP Bulletin but have not yet collected their certificates are requested to pay the prescribed fee and contact the DOI to receive their registration certificates within the same 90-day period.

Applicants who fail to contact the DOI within the specified period regarding incomplete documents or uncollected registration certificates will have their applications cancelled on the 91st day from the date of the Notice, without any further action.

Pursuant to Section 18C of the PDTA, which requires submission of evidence of trademark use within one year of registration, the Notice directs trademark owners who have not yet complied to submit evidence of use or product samples to the DOI within 60 days from the date of the Notice i.e. 17 October, 2025. Section 18C of the PDTA also empowers the DOI to cancel the registration of trademarks found to be unused upon necessary verification.
